Terms of Use

1. Acceptance of Terms

Welcome to BooFlix. By accessing or using BooFlix (the "Service"), provided by Mouthbreather LLC ("we," "our," or "us"), you agree to be bound by these Terms of Use. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these terms, please do not use the Service.

You must be at least 13 years of age to use this Service. If you are between 13 and 17 years of age, you may only use the Service with the consent of a parent or legal guardian.

2. Description of Service

BooFlix is a movie tracking application that helps users track scary movies they watch leading up to Halloween, including maintaining a movie library, watch history, ratings, and notes. BooFlix is free to use and does not require payment, a subscription, or display advertising.

BooFlix also includes optional community features: you may choose to publish your movie list under a display name so other users can browse it, and you may browse lists that other users have published. These features are off by default.

3. Accounts

You may use BooFlix with an anonymous, device-local account, or create an account with an email address and password to sync your data across devices. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. User Conduct

You agree not to use the Service to:

• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or other users' accounts.
• Use the Service for any purpose other than personal movie tracking, including commercial solicitation or spam.
• Upload content that is unlawful, defamatory, or infringes the intellectual property or other rights of any third party.

Where you make content visible to other users — currently a display name and a published movie list — you additionally agree not to:

• Choose a display name that is obscene, hateful, harassing, or that impersonates another person, organisation, or BooFlix itself.
• Publish content that harasses, threatens, or targets any individual or group, including on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age.
• Publish sexually explicit material, or content that sexualises minors in any way.
• Use a published list to advertise, solicit, distribute spam, or direct users to external sites for commercial gain.
• Publish content that reveals another person's private information.

We have zero tolerance for objectionable content and abusive users. We may remove content or suspend accounts that violate these standards, with or without notice.

5. Your Content and Published Lists

You retain ownership of the movie library, ratings, watch history, and notes you create in BooFlix. This content is private to your account by default.

You may choose to publish your movie list. Publishing makes your chosen display name and the titles in your library visible to other users. Your watch history, the dates you watched anything, your ratings, your notes, and your email address are never published. You can unpublish at any time from Settings. Anonymous accounts cannot publish a list, because such a list could not reliably be edited or removed later.

By publishing, you grant us a limited, non-exclusive licence to display that content to other users of the Service. This licence ends when you unpublish or delete the content.

You are solely responsible for content you publish, including your display name.

6. Reporting, Blocking, and Moderation

Any user can report a published list or display name from within the app. We review reports within 24 hours and will remove content or suspend accounts that violate Section 4.

Any user can also hide another user immediately, without filing a report and without waiting for us. Hidden users' lists stop appearing for you at once. Hiding is private — the person hidden is not told.

A list that attracts multiple independent reports may be hidden from other users automatically pending review. This is reversible and removes no data: the owner keeps their entire library and may publish again once the report is resolved.

7. Account Deletion

You may delete your account and all associated data at any time from within the app (Settings → Delete Account), or by submitting a data deletion request. Account deletion is permanent and cannot be undone.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. Mouthbreather LLC makes no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the Service. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that data loss will not occur. You use the Service at your own discretion and risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Mouthbreather LLC and its founders shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including the loss of any data maintained in the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service, at our discretion, if you violate these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after a change becomes effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
